Surfcaster's Access Rights - Question?

Hey Guys!

I know this subject has been discussed before on several boards - but I could'nt find what I was looking for.

What are the FL regulations/laws regarding a fisherman's right to fish on the beach? I seem to recall that it/was/is something to the effect that one can fish the beach at or below the high tide/water mark/line,..... is this correct?

Also does anybody have a/any link(s) to any FWC information on this subject?

I have looked this up before and what i have found goes from city to city.Like south beach is from 6pm to 12am,hollywood is from 6pm to 6am.Pompano has none,jupitar has none.I would just say to look it up city by city.Hope it helps.I looked them up just to be safe before i fished so i knew my rights.

ABSOLUTELY!

Very well put Sean, there is alot at stake here for all of us whose passion is pursuing these magnificent (albeit misunderstood by the public) creatures, from the beach.

There's already too much bad press about Sharks, Shark bites, Shark fishing, Big Sharks being caught and Sharks near/around the beach!

As a group, we have a responsibility to keep things under control and try to circumvent/avoid any situations that might get overly complicated - we're already apart of something that is very controversial and every time we walk out on the beach to "get it done" (especially during the daylight hours) we have to be careful and responsible .

I can think of several scenarios/examples, that I will detail in another post.

:D I WOULD LIKE TO REPLY TO THIS POST. BACK IN THE EARLY SIXTYS THERE WAS A TIME WHEN YOU COULD FISH PLACES LIKE LAKEWORTH BEACH AND PIER. BUT A HAND FULL OF SHARK FISHERMAN LEFT SHARKS ON THE BEACH WITH HEADS CUT OFF AND GUTS HANGING OUT. THE CITY CAME OUT WITH A LAW NO SHARKFISHING FROM THE BEACH.THAT WAS IN 1959. MANY MORE CITY BEACHES FOLLOWED. WE AS FISHERMAN WILL FINED NEW SPOTS. IT IS IMPORTEN THAT WE LEAVE THE SPOT AS WE FOUD IT .THIS MEANS RELEASE OUR SHARKS,DO NOT LEAVE OUR OLD BAIT ON THE BEACH AND CLEAN UP OUR MESS AND TRASH. THIS WILL HELP OUR CAUSE.

Great advice and words to the wise JD HAMMER!

I would like to add - that in the event that someone chooses to harvest/keep a Shark -or- if one has to - do to it (the Shark) not making it back out and dieing.

Please be quick and thorough - whereas any entrails, body parts be removed from the beach or put back in the ocean, not just laying around.

There have been a few times (albeit rare but non-the-less) that when, even though the Shark was put back in the water - in record time, something went wrong - and it was obviously 'gonna die.

At that point my fishing stops for the day, and I am immediately occupied with getting the Shark off the beach efficiently/quickly and on ice, I always bring contractor plastic bags with me as well as a hacksaw, etc. (in my vehicle) - in the event that something like this happens, I've also told people standing around to take their kids away from the area when I was 'gonna take care of things - out of respect to those hanging around just looking-on.

A dead Shark washing up on the beach a few hundred yd.s from where people saw you land it - only makes matters big time worse for all of us.
