Proposed Banning of Hammerhead and Tigershark Fishing

The state may ban the catch of tiger sharks and hammerheads in Florida waters, in the latest of a series of rules aimed at protecting the ocean's top predators.
The Florida Fish and Wildlife Conservation Commission plans a series of public workshops around the state to gather comments on a proposal to add these species to the prohibited list.
Sharks have undergone a severe worldwide decline over the past 20 years to serve the demand in China and other East Asian countries for shark fin soup. South Florida has emerged as a center of the shark-protection movement, particularly around the University of Miami’s Rosenstiel School of Marine and Atmospheric Science.
The commission is also considering a limit on chumming when fishing for sharks from shore. And it is considering a proposal to require circle hooks rather than j-hooks for catch-and-release fishing to cause less harm to the shark.

There is a big difference between banning fishing of a certain species and protecting a species. Banning is a huge leap; wouldn't it be more rational to add them as a non-harvest fish first?
Edit: after reading the powerpoint it looks like the motivation is to add those two species to the protected list.

And just my personal opinion - a government workshop is more like a "this is what we are going to do but we are giving you a time to voice your opinion to let you feel good about yourself (well at least we tried) but we are still going to do it anyway" shop.
You can bet this will get legislated and it will go into effect.
What will this mean: Catch and release only...as it states these sharks must be released unharmed...as reasonably possible. So I ask (short term effect) ...What about the hammerhead that fights to the end, exhausting itself, and dying dispite repeated attempts to revive it. What becomes of it? Will the fisherman then be able to keep it for it's meat/jaws/etc.? I doubt it as this will lead to fishermen, intent on harvesting, fighting a shark until it does expire so as to keep it.
Or will this law cause the shark to be left on the beach as the fisherman disappears for fear of being fined? If the fisherman is caught, or reports the loss so the carcass can be cleaned up will the fisherman that caught it be punished becaused it died (fined plus cost of cleanup, possible confiscation of fishing equipment, imprisonment)?
Long term effect - this could be a first step toward the elimination of shark fishing all together in order to save the endangered ones.
This is one of those slippery slopes... once you start down it there is no turning back.
Lastly I ask ... is recreational fishing of sharks the real problem to the decline in the shark population or is it due mainly to the longline (and netting) fishing industry (shark fin soup) that is allowed to continue, almost unhindered, around the world? Are the 40-90 million sharks caught annully worldwide from recreational fishing ( alot of which is catch and release) or the industrialized catch and kill fishing fleets of the world.

I am not a lawyer but I think I would fight that ticket based on 2010 Florida statute 316.614 f.s. which states:
Safety belt usage.—(1) This section may be cited as the “Florida Safety belt Law.”
(2) It is the policy of this state that enactment of this section is intended to be compatible with the continued support by the state for federal safety standards requiring automatic crash protection, and the enactment of this section should not be used in any manner to rescind or delay the implementation of the federal automatic crash protection system requirements of Federal Motor Safety Standard 208 as set forth in S4.1.2.1 thereof, as entered on July 17, 1984, for new cars.
(3) As used in this section:
(a) “Motor vehicle” means a motor vehicle as defined in s. 316.003 which is operated on the roadways, streets, and highways of this state....

(8) Any person who violates the provisions of this section commits a nonmoving violation, punishable as provided in chapter 318.

318.18 Amount of penalties.—The penalties required for a noncriminal disposition pursuant to s. 318.14 or a criminal offense listed in s. 318.17 are as follows:
(1) Fifteen dollars for:
(a) All infractions of pedestrian regulations.
(b) All infractions of s. 316.2065, unless otherwise specified.
(c) Other violations of chapter 316 by persons 14 years of age or under who are operating bicycles, regardless of the noncriminal traffic infraction’s classification.
(2) Thirty dollars for all nonmoving traffic violations and:
(a) For all violations of s. 322.19.
(b) For all violations of ss. 320.0605, 320.07(1), 322.065, and 322.15(1). Any person who is cited for a violation of s. 320.07(1) shall be charged a delinquent fee pursuant to s. 320.07(4).
So you have to be operating the vehicle to be cited and secondly even if you were operating the vehicle it seams the ticket should only be $30. Hope this helps.
